Terms and Conditions
1. Agreeing to these terms
These terms are an agreement between you and Shwe Lamplight LLC, a Wyoming company ("we", "us"), for the Shwe Sin Phyu app and its lessons. By installing or using the app you agree to them and to our Privacy Policy. If you do not agree, please do not use the app.
Who may use it. Learners of any age may use the app, but anyone under 18 (or under the age of adulthood where they live) needs a parent or guardian to agree to these terms for them. A parent or guardian who lets a child use the app is responsible for that use. The app asks for your birth month and year when you first open it. Learners under 13 use the app in a device-only mode in which nothing is sent online, and the online backup and accounts are not available to them.
2. Accounts, your progress, and fair use
Guest and saved accounts. The app first gives you a guest profile. If you choose "Save my progress", you link an email address so you can sign back in with a code we email you. Give a real email you can open, and keep it safe: anyone who can read that email can sign in as you.
Your progress. Your lessons, scores and answers are yours to use. You let us store them in the online backup so we can restore them for you and plan your reviews. You can delete them at any time (see the Delete my data page).
Usage counts. If you are 13 or older, the app sends a few anonymous usage counts, as described in the Privacy Policy. They are not linked to you, and you can turn them off in Settings. Learners under 13 never send them.
Fair use. Please use the app only to learn. Do not try to break it, copy its content in bulk, reverse-engineer it, bypass its limits, attack our servers or sign-in system, or use another person's account. Do not use the app for anything illegal, and do not put anything harmful or offensive into your name or nickname. We may limit or end access if the app is misused.
3. Our content, and what the lessons are for
Ownership. The course, the Burmese translations, the characters (including Sin Phyu, Thalika, Chin and Chinthay), artwork, audio, the app itself and its names belong to Shwe Lamplight LLC. We give you a personal, non-exclusive, non-transferable permission to use the app and its lessons for your own learning. You may not copy, sell, share publicly, or build on them without our written permission. The names "Shwe Sin Phyu", "ShweSinPhyu", "Shwe Lamplight" and "White Elephant English" are ours.
Your feedback. If you send us ideas or corrections, we may use them freely without paying you.
Learning aid only. The lessons are made to help you practice English. They are not a guarantee of any test score, job, visa or exam result, and they are not professional, legal or immigration advice. We work carefully, but a translation or lesson may contain mistakes; please tell us at support@shwesinphyu.com.
4. Free use and paid plans
The free pilot. Right now the app is free. We may change, pause or end any free feature, and we will try to give notice in the app when we do.
Our own offers. People on the free plan may see offers for our paid plans inside the app. These are our own offers, not third-party advertising.
Paid plans. We may offer paid plans, such as a subscription or a one-time purchase of extra levels. Before you buy, the app will show what you get, the price, how long it lasts, and whether it renews. Prices will be shown in the app and may differ by country. Paid plans are for learners 13 and over (with a parent or guardian's agreement if under 18). Learners under 13 use the app in device-only mode and get the free version. A learner under 13 may use a paid plan only with a parent or guardian's permission: the parent or guardian must make and approve the purchase through their own App Store or Google Play account (for example with Apple Family Sharing "Ask to Buy" or Google Family Link). The app still sends nothing online for a learner under 13.
Billing goes through the app store. Purchases are made and charged by Apple App Store or Google Play, not by us. Their payment terms apply, and we never see your card details. A subscription renews automatically at the end of each period until you cancel it in your App Store or Google Play account settings, at least 24 hours before the renewal date. Deleting the app does not cancel a subscription.
Refunds. Refund requests are handled by Apple or Google under their own rules. If you need help with a refund, write to support@shwesinphyu.com with your receipt.
Price changes. If we raise the price of a plan, we will tell you before it applies and, where the store requires it, ask you to agree before your next renewal.
5. Ending use, disclaimers, liability, law, and changes
Ending use. You can stop at any time by deleting your data and the app. We may suspend or end your access if you break these terms or if we shut the app down. If we shut it down, we will try to give notice first.
No warranty. The app is provided "as is" and "as available". We do not promise that it will always work, be error-free, or be available without interruption, or that your online backup will never be lost. Keep in mind that the lessons also run on your phone without internet.
Limit of liability. To the extent the law allows, Shwe Lamplight LLC is not responsible for indirect or consequential losses, and our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Some places do not allow these limits, so they apply to you only as far as your local law permits. Nothing here limits rights you cannot give up by law.
Governing law. The laws of the State of Wyoming, USA, govern these terms, without regard to conflict-of-law rules. Any dispute that we cannot settle by writing to each other first will be brought in the state or federal courts located in Wyoming, and you and we agree to those courts. If you are a consumer, you also keep any rights your own country's laws give you that cannot be waived.
Changes. We may update these terms. If a change matters, we will tell you in the app before it begins. If you keep using the app after the date shown, you accept the new terms.
